Responsibilities:
- Client Advisory: Provide expert legal advice to clients on ERISA compliance, employee benefit plans, retirement plans, and health and welfare plans. Assist with plan design, implementation, and administration to ensure adherence to ERISA requirements.
- Plan Documentation and Compliance: Review, draft, and update plan documents, summary plan descriptions, and other related materials to ensure compliance with ERISA and other applicable federal regulations.
- Fiduciary Duties: Advise clients on fiduciary responsibilities and obligations under ERISA, including investment decisions, plan administration, and conflict-of-interest issues. Ensure that fiduciaries act in the best interests of plan participants and beneficiaries.
- Litigation Management: Represent clients in disputes and litigation involving ERISA-related issues, such as claims for benefits, fiduciary breaches, and plan mismanagement. Develop case strategies, conduct legal research, and advocate on behalf of clients in court or arbitration.
- Regulatory Compliance: Help clients navigate and comply with regulations from agencies such as the Department of Labor (DOL), the Internal Revenue Service (IRS), and the Pension Benefit Guaranty Corporation (PBGC). Address regulatory inquiries and investigations as needed.
- Plan Audits and Investigations: Assist clients with internal audits and investigations related to employee benefit plans. Identify and address compliance issues, and implement corrective actions to resolve deficiencies.
- Training and Education: Develop and deliver training programs for clients on ERISA compliance, fiduciary responsibilities, and best practices for plan administration. Educate clients on recent legal and regulatory developments.
- Policy and Strategy Development: Help clients develop policies and strategies related to employee benefits and retirement plans, including plan design, risk management, and cost control measures.
- Business Development: Engage in activities to attract new clients and expand the firm’s ERISA practice. Network with industry professionals, participate in industry events, and contribute to thought leadership in ERISA law.
- Team Leadership: Lead and mentor a team of junior lawyers, associates, and paralegals specializing in ERISA matters. Delegate tasks, review work, and provide guidance to ensure high-quality legal services and professional development.
- Ethics and Compliance: Ensure that all legal practices adhere to ethical standards and regulatory requirements. Maintain high professional and ethical standards in all aspects of work.
- Reporting and Communication: Provide regular updates and reports to clients on the status of legal matters, regulatory changes, and strategic recommendations. Communicate effectively with clients, regulatory agencies, and opposing counsel.
